Human error and misconduct, including speeding, failure to pay attention, cell phone use, and impaired driving, accounts for the vast majority of traffic accidents. Manufacturers, researchers, and advocates are attempting to develop two separate vehicle based systems to compensate for human factors: automatic vehicles and Driver Alcohol Detection System for Safety (DADSS). Implementation of each of these technologies, individually and in combination, will raise a host of legal and policy issues and concerns that must be considered. In this article, which is intended to open some much needed discussion of the issues, we introduce the reader to each of these systems and some of the legal and policy questions they raise.
